Thank you very much for your interest in purchasing our products through our online store. Below we detail the general terms and conditions (GTC) for our products purchased through our online store caldoscooldo.com (hereinafter the "Website").
1.IDENTIFICATION
In compliance with article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the identifying data of the commercial company that owns the online store hosted under the domain name www.caldoscooldo.com are set out below.

- PURPOSE OF THE GENERAL CONDITIONS OF SALE OR CONTRACT
The purpose of this document is, first, to inform potential buyers of the terms and conditions under which COOLDO TE CUIDA SL sells and delivers the products ordered and, second, to define the rights and obligations of the parties within the framework of the sale of products by COOLDO TE CUIDA SL to the buyer (hereinafter, the "Buyer"). These purchase conditions apply to all sales of products offered by COOLDO TE CUIDA SL through the Website.
The purchase of any of the products offered on the Website implies the express, unreserved acceptance, as a Buyer, of the Terms and Conditions of Sale and Legal Notice.
COOLDO TE CUIDA, SL sells and distributes the products offered on the Website to customers located in the peninsula, that is, Spain, except for the Balearic Islands, the Canary Islands, Ceuta and Melilla.
The products offered on the Website are intended for end consumers under the terms and conditions established by Law 7/1996, of January 15, on the Regulation of Retail Trade. Therefore, any purchase requests outside the parameters of an average consumer and/or mass orders from a single buyer and/or recipient may not be fulfilled.
- BUYER CONDITION
Browsing the Website does not constitute a Buyer, as you have free access to information regarding the products offered. Buyer status is acquired when you place an order.
The User who wishes to place an order is obliged to:
- Provide truthful information about the data requested in the registration form and keep it updated.
- Provide a valid address to enable delivery of orders within normal delivery hours. In the event of non-compliance with this obligation by the Buyer, COOLDO TE CUIDA SL will not be liable for any delay or failure to deliver the order.
- Do not use false identities or impersonate another Buyer by using their login details.
4 FORMALIZATION OF SALES AND ORDERS
4.1 Rates
The selling price, indicated in euros, of the products offered on the COOLDO TE CUIDAS.L Website will be the price in effect at the time the order is placed (hereinafter, "Order"). The selling price of the products appearing on the Website may be modified at any time by COOLDO TE CUIDA SL, and the price applied to the purchase will be the one shown on the screen at the time the Order is placed. This price will be the one applicable to distance selling.
COOLDO TE CUIDA SL will make its best efforts to periodically check and verify any errors in the prices of the products offered on the Website. In the event of any error in the prices shown on the Website, COOLDO TE CUIDA SL will act as follows: (a) if the correct price is lower than the one shown on the Website, COOLDO TE CUIDA SL will charge its members the lower price and proceed with the shipment of the product(s); (b) if the correct price is higher than the one shown on the Website, and the error is of such magnitude that a person/consumer with average knowledge could intuit that it is an error, COOLDO TE CUIDA SL will contact the Buyer to give the corresponding instructions, either to continue with the order or cancel the order at no cost to the Buyer.
The price includes shipping costs for orders over €54. The different delivery and shipping methods are set out in section 6.1 of these Terms and Conditions and will be posted on the Website. COOLDO TE CUIDA SL may modify these shipping methods at any time. Therefore, COOLDO TE CUIDA SL recommends that buyers periodically check the sales policy.
Prices will include the Value Added Tax (VAT) applicable on the date of the Order in accordance with current regulations. Any change in the applicable rate will automatically affect the price of the products COOLDO TE CUIDA SL sells on the Website.
4.2 Product characteristics
The Buyer may select one or more products from among the different products offered by COOLDO TE CUIDA SL on the Website.
In accordance with applicable regulations, the Buyer will have the opportunity, prior to placing an Order, to view the essential characteristics of the products they wish to purchase on the Website.
The products will comply with the requirements of current Spanish legislation.
4.3 Order
Placing an Order by the buyer implies acceptance of these Terms and Conditions and the provisions set forth in the Legal Notice, as well as the declaration that they have read and are aware of the Privacy Policy and the Cookie Policy, without prejudice to any specific conditions that the Parties may agree upon.
The Buyer will have the opportunity to check the details of their Order and correct any errors before making the payment on the screen prior to formalizing the purchase by confirming and making the payment.
From the moment the Buyer confirms their Order by clicking on the "Pay Now" icon, it will be considered that they have fully accepted the content, characteristics and conditions of the products offered and of the Order in question and, specifically, these General Conditions of Sale and that they assume the obligation to pay for their purchase.
Once this phase has been validated and the order has been prepared, the Buyer may no longer cancel their Order. The sale will be final (subject to the Buyer's right of withdrawal under the conditions set forth in Article 7 of these General Conditions of Sale). The Order will be confirmed by COOLDO TE CUIDA SL by sending an email to the Buyer (the "Order Confirmation Email"), which will include a link with specific shipping information and tracking information. A second email will be sent to the Buyer at the time their Order is shipped.
COOLDO TE CUIDA SL recommends that the Buyer retain these two email addresses. The Buyer is informed that both email addresses will be sent to the email address provided for identification during the registration process, prior to placing the Order.
Furthermore, COOLDO TE CUIDA SL assumes no liability in the event of an error in entering the email address or failure to receive the Order confirmation email. In these cases, the sale will be final, except in the event of cancellation of the Order by COOLDO TE CUIDA SL, especially in the case of products that are no longer available. However, the Buyer may exercise their right of withdrawal under the conditions set forth in Article 7 of these General Conditions of Sale.
In accordance with applicable regulations, COOLDO TE CUIDA SL reserves the right to refuse or cancel for legitimate reasons any Order in which the number of products or the amount to be paid (for a single order or for several accumulated orders) or other elements are manifested in a way that shows the development by the Buyer of an economic activity related to the products ordered that has not been reported to the Seller or, in general, any abnormal Order according to the average consumption and customs of the customers.
Finally, COOLDO TE CUIDA SL reserves the right to suspend or cancel the execution and/or delivery of an Order, regardless of its nature and degree of execution, in the event of total or partial non-payment of the amounts owed by the Buyer, in the event of payment incidents or in the event of fraud, whether completed or attempted, related to the use of the COOLDO TE CUIDA SL Website, including fraud committed in connection with previous Orders.
- PAY
5.1 Payment methods
Bank cards
The payment method for purchases on the Website is by bank card. The bank cards accepted on the Website are: Visa, MasterCard, and Maestro.
All bank cardholders are subject to validation checks and authorization by the card issuer. If the buyer's payment card issuer denies or for any reason does not authorize payment to us, either before or after a payment, we will not be liable for any delay or non-delivery.
5.2 Payment methods
All orders must be paid in full in euros, including all mandatory taxes and duties. Any bank charges the entity may impose on the buyer for electronic purchases or payments will be borne by the buyer, if applicable.
5.3 Security in payment transactions
In order to guarantee the security of payments made by bank card, the Buyer must communicate to COOLDO TE CUIDA SL the visual cryptogram (CVV) that appears on the back of the bank card used by the Buyer.
In the context of the fight against online fraud, data relating to the Buyer's Order may be communicated to third parties authorized by law or designated by COOLDO TE CUIDA SL, for the sole purpose of verifying the Buyer's identity, as well as the validity of the Order, the payment method used, and the expected delivery.
Once this check is completed, COOLDO TE CUIDA SL reserves the right to request proof of the authenticity of the Buyer's identity and/or any other information relating to the Buyer's identity. The Buyer has the rights granted by personal data protection regulations as provided in the Privacy Policy.
COOLDO TE CUIDA SL uses secure payment tools and does not have access to the data provided via digital payment methods. Payment security depends on the authentication of the Buyer and the confidentiality of all data. To guarantee this security, the tool uses proven cryptographic techniques and meets the requirements established in the various banking regulations applicable in Spain and the EU.
- DELIVERY AND RECEIPT
6.1 General provisions
The products ordered by the Buyer in accordance with the provisions of these GTC may be sent to the address indicated by the Buyer as the delivery address for the corresponding Order.
COOLDO TE CUIDA SL only delivers to the peninsula, excluding the Balearic Islands, the Canary Islands, Ceuta and Melilla.
If the Purchaser of the Order is absent from the address provided at the time of delivery, the Purchaser or the recipient of the Order will receive a notification from the agency (email, SMS), informing them whether their Order will have another delivery attempt or will be available at a collection point.
If delivery cannot be made due to lack of action by the buyer within a period of 15 days, the package will be returned to COOLDO TE CUIDA SL and the money will not be refunded to the Buyer.
No claim regarding delivery will be accepted when the package is listed as delivered, for which purpose the carrier's computer system (identification) will be reliable.
6.1.1 Cost of shipping the Order
Orders will be free of charge if they are equal to or greater than SIXTY EUROS (€60.00). For orders under this amount, the shipping cost will be determined at the time of the order summary and before the purchase is finalized.
6.2 Anomalies, damage or damaged packages
6.2.1 General provisions
The Buyer, or the recipient of the Order, is advised to check the external condition of the package and the products at the time of delivery.
In the event of an anomaly related to the package (damaged package, open package, liquid residue, etc.) or related to the product(s) ordered (missing product(s), damaged product(s)), the Buyer must follow the appropriate procedure, from those described below (in articles 6.2.2 and 6.2.3 of these General Conditions of Sale).
Failure to follow the appropriate procedure will exclude the possibility of filing a claim against the carrier and COOLDO TE CUIDA, SL and, consequently, the Buyer will not be able to demand any refund or replacement of the affected products.
Likewise, the Buyer or the recipient of the Order may write to COOLDO TE CUIDA SL's Customer Service Department to learn how to return the damaged product(s). In this case, the Buyer shall be obliged to follow the procedure for returning damaged products as indicated by COOLDO TE CUIDA SL's Customer Service Department. Otherwise, the Buyer may not request a refund or replacement of the affected products.
6.2.2 Mandatory procedures in case of damaged package
- In case of an incident confirmed in the presence of the transport company:
– Refuse delivery and clearly and in detail explain the incident.
– Indicate the reason for the rejection of delivery via email to hola@caldoscooldo.com
- In case of incidents reported without the presence of the transport company:
– Report the anomaly to COOLDO TE CUIDA SL Customer Service by emailing hola@caldoscooldo.com.
Incidents and complaints must be reported as soon as possible and, in any case, within three calendar days (Sundays are not counted) from the date of delivery of the product, including the day of receipt.
6.2.3 Mandatory procedures in case of missing or damaged product
The Buyer must report any missing or damaged product to COOLDO TE CUIDA SL's Customer Service Department using the means and within the timeframes specified in the previous section. COOLDO TE CUIDA SL's Customer Service Department may request any information relating to the identity of the Buyer or recipient of the Order and carry out any necessary verifications.
COOLDO TE CUIDA, SL's Customer Service will inform the Buyer how to proceed with the return of the damaged product.
6.3 Delivery times
Delivery times begin from the date the Order confirmation email is sent.
Once payment has been confirmed, the order will be sent to the delivery address provided by the Buyer.
Shipping will be done through Mail Box.
Deliveries are made within 24/48 hours for orders placed before 9:00 a.m. For orders placed after 9:00 a.m., the delivery time will be 48/72 hours.
Order delivery days are Monday through Friday, excluding national and international holidays.
You can track the status of your orders through the link in your confirmation and tracking emails.
To resolve any questions regarding the shipping and delivery process, once we've sent you the email confirming your order has been shipped, you can contact the shipping company directly, providing the tracking number.

- WITHDRAWAL, RETURN AND REFUND
7.1. Right and period of withdrawal
7.1.1. Deadline for exercising the right of withdrawal
You have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.
To exercise your right of withdrawal, you must notify COOLDO TE CUIDA, SL, by email at hola@caldoscooldo.com, of your decision to withdraw from the contract. This must include your name, full postal address, telephone number, email address, and order number.
To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.
7.1.2. Products excluded from the right of withdrawal
In accordance with applicable regulations, the legal right of withdrawal cannot be exercised in the case of Orders relating to:
- The supply of items that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons.
7.1.3. Consequences of exercising the right of withdrawal
When products are eligible for the legal right of withdrawal, the Buyer who exercises their right of withdrawal under the conditions set forth in this article, both in relation to the period and the methods of returning the products, may obtain a refund of the amount paid for the purchase of the returned products. The refund of the amount paid must be made without further delay, and in any case, before FOURTEEN (14) calendar days from the date the order arrives at our facilities. The refund will be made using the same payment method used by you for the initial transaction.
7.1.4. Expenses
In accordance with applicable regulations, the costs of returning products shall be borne by the Buyer, except in the case of non-compliance with the products delivered with the Order (in which case the return costs shall be borne by COOLDO TE CUIDA, SL).
7.2. Methods of exercising the right of withdrawal
7.2.1. General provisions applicable to all return methods
Products must be returned in a condition suitable for sale (products in perfect condition, accompanied by their original packaging, accessories, leaflet, etc.) within a maximum period of fourteen (14) days from the date of receipt. Returns of products made after this period will not be accepted.
The products must be accompanied by the Order number, it is the Buyer's responsibility to package the products so that they arrive correctly to our facilities.
The Buyer may be held liable in the event of depreciation of the product as a result of handling of the product other than that necessary to establish the nature and characteristics of the products.
7.3.2. Return
COOLDO TE CUIDA, SL's Customer Service will inform the Buyer how to proceed with the return of the products.
In the event that the Buyer does not effectively demonstrate that he has secured the deposit of the product with the carrier, the risks associated with the return of the product will be borne by the Buyer.
- WARRANTY
The warranty period for the products is ONE (1) YEAR, from the delivery of the product, although it does not include deficiencies caused by negligence, knocks, incorrect use or improper handling.
In cases that justify the application of the warranty, the option will be repair, replacement of the product, discount, or refund, under the legally established terms.

- RESPONSIBILITY
10.1 Capacity
Prior to placing their Order, the Buyer declares that they have full legal capacity to be bound by these General Conditions of Sale. Therefore, if a person lacking legal capacity places an Order for items on the Website www.caldoscooldo.com , that person's legal guardians (particularly parents or guardians) will assume full responsibility for said Order and, specifically, will be responsible for the price thereof.
10.2 Limitation of liability
The liability of COOLDO TE COOLDO, SL for the obligations established in these General Conditions of Sale may not be demanded when the failure to comply with said obligations is attributable to the actions of third parties, even when said actions were foreseeable, to the fault of the Buyer, to the occurrence of a circumstance of force majeure, as defined in the applicable jurisprudence, to the occurrence of any other circumstances that reasonably escape the exclusive control of COOLDO TE COOLDO SL or to the unsuitability of the products for the use that the Buyer plans to make of them if said suitability has not been confirmed by the seller.
COOLDO TE CUIDA SL is not responsible in any case for the Buyer using the Website in a manner contrary to law, morality and public order.
- APPLICABLE LAW AND CORRESPONDING JURISDICTION
The Sales Policy will be governed and interpreted in accordance with the legislation applicable in Spain and the relationship between COOLDO TE CUIDA SL and the Buyer will be governed by the Spanish regulations in force at the time of formalization of the contract and any dispute will be submitted to the National Consumer Arbitration Board.

IT IS ALWAYS IN THE INTEREST OF COOLDO TE CUIDA SL TO TRY TO RESOLVE ANY CONFLICT IN A FRIENDLY MANNER
COOLDO TE CUIDA SL reserves the right to file any civil or criminal actions it deems appropriate for improper use of the Website, its contents, or for damages suffered not directly related to consumer matters.
